1. Agreement to Terms
By accessing and using the services of Lifez Catalysts ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Equipment Rental Services
Lifez Catalysts provides equipment rental services including but not limited to:
- Construction equipment (excavators, bulldozers, cranes)
- Industrial machinery
- Commercial vehicles and trucks
- Material handling equipment
- Related accessories and attachments
3. Rental Agreement
3.1 Rental Period
The rental period begins when equipment is delivered or picked up and ends when equipment is returned and accepted by Company. Minimum rental periods may apply.
3.2 Payment Terms
- Rental fees are due in advance or as specified in the rental agreement
- Late fees may apply for overdue payments
- Security deposits may be required
- Additional charges may apply for damages, excessive wear, or cleaning
3.3 Delivery and Return
Equipment delivery and pickup are subject to availability and scheduling. Customer is responsible for ensuring safe access to delivery/pickup locations.
4. Customer Responsibilities
4.1 Equipment Use
- Use equipment only for intended purposes and within rated capacities
- Operate equipment safely and in accordance with manufacturer guidelines
- Ensure operators are properly trained and certified
- Perform routine maintenance and inspections as required
4.2 Safety and Compliance
- Comply with all applicable safety regulations and standards
- Maintain adequate insurance coverage
- Report accidents or incidents immediately
- Follow all applicable federal, provincial, and local laws
4.3 Equipment Care
- Protect equipment from theft, vandalism, and damage
- Keep equipment clean and in good condition
- Use appropriate fuels, lubricants, and fluids
- Store equipment securely when not in use
5. Liability and Insurance
5.1 Customer Liability
Customer assumes full responsibility for equipment from delivery until return. Customer is liable for all damage, loss, or theft regardless of cause.
5.2 Insurance Requirements
Customer must maintain comprehensive general liability insurance and property insurance covering the full replacement value of rented equipment.
5.3 Limitation of Liability
Company's liability is limited to the rental fees paid. Company is not liable for consequential, indirect, or punitive damages.
6. Equipment Condition and Maintenance
6.1 Pre-Rental Inspection
Equipment is inspected before rental. Customer should report any discrepancies immediately upon delivery.
6.2 Maintenance During Rental
Customer is responsible for daily inspections, routine maintenance, and minor repairs during the rental period.
6.3 Major Repairs
Major repairs require Company authorization. Unauthorized repairs may void warranty and result in additional charges.
7. Termination and Default
7.1 Termination Rights
Either party may terminate the rental agreement with proper notice. Early termination may result in additional fees.
7.2 Default
Default occurs upon:
- Non-payment of rental fees
- Violation of terms and conditions
- Misuse or abuse of equipment
- Insolvency or bankruptcy proceedings
7.3 Remedies
Upon default, Company may immediately terminate the agreement, repossess equipment, and pursue all available legal remedies.
8. Indemnification
Customer agrees to indemnify and hold Company harmless from all claims, damages, costs, and expenses arising from the rental or use of equipment.
9. Force Majeure
Neither party is liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, government actions, or other force majeure events.
10. Governing Law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any disputes will be resolved in the courts of Quebec.
11. Modifications
Company reserves the right to modify these terms at any time. Changes will be effective upon posting on our website. Continued use of services constitutes acceptance of modified terms.
12. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
